These Terms of Service ("Terms") govern your use of QuizzyNest and related services provided by QuizzyNest Ltd ("QuizzyNest", "we", "us", or "our").

By accessing, subscribing to, or using QuizzyNest, you agree to these Terms. If you do not agree, you must not use the service.

1. Eligibility and parent-controlled accounts

• Adults only: Only a parent or legal guardian aged 18 or over may create and manage a QuizzyNest account.
• Parent-controlled use: Accounts are intended to be created, purchased, and controlled by a parent or legal guardian.
• Accurate information: You agree to provide accurate account and billing information and to keep it reasonably up to date.

2. The Avatar system

• Avatar profiles: Learner profiles inside the service must use a fictional or nickname-style Avatar name selected by the parent or legal guardian.
• No real first names: Do not use a learner’s real legal first name in the Avatar profile unless we expressly ask you to do so in a lawful and clearly explained way.
• Age or age band: You may be asked to provide age or age-band information so that content can be matched to the right level.

3. Free trials, subscription billing, and renewal

3.1 Subscription plans

QuizzyNest may offer monthly, annual, trial, or other subscription options. The plan, billing frequency, and price selected at checkout form part of your contract with us.

3.2 Automatic renewal

Where your plan is recurring, your subscription will renew automatically at the end of each billing cycle unless you cancel before the next renewal date.

3.3 Trial conversion

If a free trial or introductory offer applies, and you do not cancel before it ends, your subscription will convert to the paid plan shown at checkout and the payment method on file may be charged automatically.

3.4 Cancellation

You may cancel your subscription at any time to prevent future renewal charges. Unless we state otherwise at checkout, cancellation takes effect at the end of the current paid billing period, and you will continue to have access until then.

4. Digital content, immediate access, and cancellation rights

QuizzyNest supplies digital content and digital services. In some cases, access to paid features, reports, or other digital content may begin immediately after purchase or during a trial period.

Where applicable law requires it, and where digital content or digital services begin immediately, you may be asked at checkout to expressly consent to immediate supply and to acknowledge that doing so may affect or limit any cancellation right that would otherwise apply once supply has started.

Nothing in these Terms removes or limits any consumer rights that cannot lawfully be excluded.

5. Refunds and statutory rights

Because QuizzyNest is primarily a digital subscription service, refunds are generally limited once paid access, paid reports, or paid digital content have been supplied, except where required by law or where we choose to offer a refund in our discretion.

• We do not generally provide pro-rated refunds for unused time in an active billing period.
• The trial period or introductory period, where offered, is intended to allow you to evaluate the service before full paid renewal.
• Any separate refund rules published on our Refund Policy page form part of these Terms.

Your statutory rights are not affected. If digital content or services are faulty, not as described, or not supplied with reasonable care and skill where applicable law provides those protections, you may have legal remedies in addition to anything written in these Terms.

6. Acceptable use

You agree not to:

• share account access outside your permitted household or plan terms;
• copy, scrape, reproduce, resell, republish, or commercially exploit the service or its content without permission;
• upload or submit unlawful, abusive, misleading, or harmful material;
• attempt to interfere with service security, payment systems, automation, infrastructure, or account protections;
• use the service in a way that could harm QuizzyNest, other users, or third parties.

7. Intellectual property

QuizzyNest and its content, including branding, layout, written materials, reports, quizzes, feedback text, graphics, downloadable materials, and related intellectual property, belong to QuizzyNest Ltd and/or its licensors, except where otherwise stated.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the service for personal, non-commercial family use in accordance with these Terms.

8. Third-party providers and integrations

We use third-party providers to operate the service, including payment, database, email, hosting, security, and infrastructure partners. These may include providers such as Stripe, Supabase, MailerLite, reCAPTCHA, and similar tools.

We are not responsible for the independent terms, privacy practices, or external downtime of third-party services, but we remain responsible for our own legal obligations to you under applicable law.

9. Service availability

We aim to provide a reliable service, but we do not promise that QuizzyNest will always be uninterrupted, error-free, or available at all times. We may suspend, restrict, or interrupt access where reasonably necessary for:

• maintenance, upgrades, fixes, or security work;
• fraud prevention, abuse prevention, or service protection;
• legal or regulatory reasons;
• events beyond our reasonable control.

10. Limitation of liability

Nothing in these Terms excludes or limits liability where exclusion would be unlawful, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any consumer rights that cannot legally be excluded or restricted.

Subject to the paragraph above, and to the maximum extent permitted by law, QuizzyNest will not be liable for indirect, incidental, special, consequential, or purely economic losses, including loss of profits, loss of opportunity, or loss of goodwill, arising from use of the service.

Where the law allows us to limit liability, our total liability relating to a subscription period will not exceed the total amount you paid to us for the affected subscription period, unless a different limit is required by law.

11. Suspension and termination

We may suspend or terminate access to the service where reasonably necessary, including where:

• you materially breach these Terms;
• you engage in fraud, payment abuse, account sharing, security abuse, or misuse of the service;
• continued access would create legal, technical, or security risk.

Where appropriate, we may give notice and an opportunity to correct the issue before termination. In serious cases, we may act immediately.

12. Changes to the service and these Terms

We may update or improve the service from time to time. We may also update these Terms to reflect changes in our service, pricing structure, legal obligations, or business operations.

When we make material changes, we will update the “Last updated” date and, where appropriate, provide additional notice.

13. Governing law

These Terms are governed by the laws of England and Wales, except where mandatory consumer protection laws in your place of residence apply and cannot lawfully be excluded.

If you are a consumer, you may have the right to bring legal proceedings in the courts available to you under applicable law.
